On October 17, 2008, Professor Eric E. Bensen moderated a debate “Changing Corporate Teams: Will the New Team Inevitably Get to Use the Old Team’s Playbook?” a discussion on Trade Secret Law’s Inevitable Disclosure Doctrine. Held in Cooperstown, New York, the debate was sponsored by the New York State Bar AssociationIntellectual Property Section. Panelists addressed the complex issues that arise when a company seeks to enjoin a former employee from taking a position with a competitor on the grounds that the former employee will “inevitably” disclose the company’s trade secrets in the new position.
