Prof. Ronald Colombo Joins Other Signators to Amicus Brief in Merck v. Reynolds

Professor Ronald J. Colombo joined a wide group of other securities law scholars and signed on to an amicus brief in the Supreme Court case Merck v. Reynolds.

The amicus brief addresses the question of when the limitations period commences for private actions for securities fraud brought under Section 10(b) of the Securities Exchange Act of 1934 and Rule 10b-5 promulgated thereunder.

The scholars on the brief agree that Congress, in adopting Section 1658(b), did not legislate an inquiry-notice standard, but rather an actual-notice standard, despite the contrary view of numerous lower courts.
