“Do we get some justices who wouldn’t be able to get through a merit appointment process or democratic election process? Yes,” said Hofstra Law School Professor James Sample. “That’s a disservice to candidates who don’t have the opportunity to compete merely because they don’t have party boss connections” but that there is “very little momentum if any to change the process legislatively because the foxes are guarding the henhouse.”
