Professor Frank Gulino’s article on the use of referenda to determine the right of same-sex partners to marry has been published in the January 2013 issue of The Matrimonial Strategist. The article, For Better or for Worse: The Case Against Referenda on Marriage Equality, posits the inappropriateness of using popular-vote initiatives to decide whether same-sex partners should have the right to marry, even in the wake of historic ballot box victories legalizing same-sex marriage in three states.
