Professor Eric Freedman was quoted in the Daily News article, “Death penalty for causing miscarriages? Cleveland kidnapper may become first on death row for beating woman until she miscarried,” where he discusses using the death penalty in the case against Ariel Castro.
“He kidnapped these women for years and repeatedly raped them,” he said. To invoke the death penalty, “the prosecutor would have prove intent to kill. And that is a very heavy lift.”
