Prof. Irina Manta Quoted in Law360 Story on Fighting Digital Film Piracy

Professor Irina Manta was quoted in the article “Calif. AG Tees Up Preemption Fight On Film Piracy” on Law360, which discusses the California attorney general’s office’s efforts to fight against digital piracy.

“Kamala Harris certainly recognizes the preemption issue and her office tried to prosecute the defendants under garden-variety theft statutes to try to avoid the problem,” said Irina Manta of Hofstra University’s Maurice A. Deane School of Law. “The courts that have dealt with this problem so far appear to agree that to survive a preemption challenge … the state law claim has to contain an extra element not present in copyright law.”
