Colombo also noted that while the suit includes claims that the rule will harm both broker-dealers and investors, the actual legal allegations will have less to do with the impact of the rule and more with whether the DOL followed the Administrative Procedure Act to the letter.

“Whether this rule is wise, whether it will help or hurt investors in this economy, that’s actually not going to be on any judge’s plate,” he said.
