Prof. Julian Ku, John Yoo Publish Los Angeles Times Op-Ed ‘Trump Might Be Stuck With NAFTA’
Julian Ku, the Maurice A. Deane Distinguished Professor of Constitutional Law, published (with UC Berkeley law professor and American Enterprise Institute visiting scholar John Yoo) the op-ed “Trump Might Be Stuck With NAFTA” in the Los Angeles Times on Nov. 29, 2016.
The next day, the piece was republished in the Chicago Tribune with the headline “Sorry, Trump: NAFTA Isn’t Going Anywhere.”
The upshot is that President Trump cannot on his own terminate U.S. participation in NAFTA or, for that matter, in the World Trade Organization. Congress enacted both agreements as statutes, so they can be reversed only by another, repealing statute enacted by the House and the Senate and then signed by the president.
