Gorsuch Could Tip Scales Against SEC’s Admin Court

Colombo said that, even if Judge Gorsuch or Republican lawmakers succeeded in pulling back Chevron deference, it would only modestly rein in agency power by subjecting administrative interpretations to de novo review. But he agreed the agencies, including the SEC, would lose more such cases.

“I would not want to be an administrative agency defending a rule before a Supreme Court with Judge Gorsuch,” Colombo said.
