Professor Ronald J. Colombo joined a group of former SEC officials and law professors in signing an amicus brief in In re Goldman Sachs Group, Inc. Sec. Litig., No. 18-2557 (2d Cir. 2018).
The brief argues that the district court erred in permitting generic statements of corporate principles and risk factors to sustain class certification under Federal Rule of Civil Procedure 23(b)(3) pursuant to a radical and unsupported version of the “price maintenance” theory.
